How a quit notice ends a tenancy
A notice to quit is used to end a periodic tenancy, such as a yearly or monthly tenancy that rolls on from one period to the next. Either side can serve one, but most are served by landlords.
What the law says now (Lagos). Where the tenancy agreement does not set a notice period, the Tenancy Law of Lagos State 2011 sets minimums that depend on the type of tenancy: tenant at will, monthly, quarterly, half-yearly or yearly. The figures box lists each. For quarterly, half-yearly and yearly tenancies in Lagos, the notice does not have to end on the anniversary of the tenancy.
When no notice to quit is needed. If the tenancy was for a fixed term that has simply run out, no notice to quit is needed in Lagos. The landlord goes straight to the notice of owner's intention.
What comes next. When the notice to quit expires and the tenant is still there, the landlord serves a notice of owner's intention to recover possession. Only after that can the landlord file a case in court. A court can then order possession and give the tenant time to leave.
Getting it right matters. Courts throw out cases where the notice is the wrong length, served on the wrong person or wrongly dated. That is why landlords usually have a lawyer prepare it.
Differences by state
- Lagos: default periods come from the 2011 Tenancy Law, which does not apply in Apapa, Ikeja GRA, Ikoyi and Victoria Island.
- Abuja (FCT): the Recovery of Premises Act applies. Its default periods for tenants at will and monthly, quarterly and yearly tenancies match Lagos, but it is less clear on half-yearly tenancies, so take advice before serving or relying on one.
- Other states: each has its own recovery-of-premises or rent law. Check which applies before serving or relying on a notice.
What to check
- The type of tenancy (yearly, monthly and so on), from the agreement and how rent is paid.
- Whether the agreement sets its own notice period.
- That the notice names the tenant and the property correctly and is signed by the landlord or their agent or lawyer.
- The date it was served and the date it expires, counted correctly.
- How it was served, and proof of service.
Red flags
- A "quit notice" followed by the landlord changing locks or cutting power. That is self-help eviction and is unlawful.
- A notice that gives less time than the law or the agreement requires.
- A notice served by someone who cannot show they act for the landlord.
- Threats to remove belongings before any court order.

Questions
How many months notice for a yearly tenant in Lagos?
If the agreement says nothing, the 2011 Lagos law sets a minimum for yearly tenants; the figures box shows it. The agreement can set a different period.
How much notice must a landlord give a tenant?
It depends on the tenancy type and the agreement. A quarterly or half-yearly tenant in Lagos gets a shorter default period than a yearly tenant. Check the figures box against your tenancy type.
What happens after a quit notice expires?
The landlord must serve a notice of owner's intention to recover possession, then go to court. The landlord cannot force you out without a court order.
Is a quit notice the same as eviction?
No. A quit notice ends the tenancy. Eviction can only happen when a court orders possession and the order is carried out lawfully.
Can a tenant give the landlord a quit notice?
Yes. A tenant who wants to leave a periodic tenancy gives notice in the same way, following the agreement or the default period.
Is a quit notice needed when my fixed-term lease ends?
Not in Lagos. When a fixed term runs out, the landlord serves only the notice of owner's intention before going to court.
