Legal fee (lawyer's fee)

Last checked 13 October 2026 · Checked by the Property Centre content team

A legal fee, in Nigerian renting, is the one-off charge for the lawyer who prepares or checks the tenancy agreement. The incoming tenant usually pays it, often to the landlord's lawyer, and it is commonly quoted as a percentage of the yearly rent. It is separate from rent and is not refunded.

Also called: lawyer's fee, legal fees, legal and agreement, lawyer fee, legal fee for rent

What the legal fee pays for

Most Nigerian lettings come with a written tenancy agreement, drafted by a lawyer acting for the landlord. The tenant is then asked to pay that lawyer, alongside the rent, the agency fee and the caution fee.

Listings often show it as "legal", "legal fee" or "agreement and legal". Some landlords charge an agreement fee and a legal fee for what is really the same document. Ask what each line pays for.

What the law says now (Lagos). The Tenancy Law of Lagos State 2011 does not set a percentage for legal or agreement fees. It says the party who engages a professional in respect of the tenancy agreement pays that professional. If the landlord instructed the lawyer, that rule points at the landlord, although tenants pay in almost every Lagos letting.

What officials say. The Lagos governor's special adviser on housing said in 2025 that collecting more than a stated share of annual rent as agreement or legal fees breaks state rules. The figures box gives that share and its sources. It is an official statement, not a figure written into the 2011 law.

What may change. The 2025 Lagos tenancy Bill keeps the "whoever hires pays" rule and requires every charge to be written into the agreement. Some explainers say it caps legal fees too; the draft text we read caps agent commission only.

Differences by state

  • Lagos: the official statement on agreement and legal fees applies; the 2011 law itself has no percentage.
  • Abuja (FCT): no cap found. The fee is agreed between the parties.
  • Elsewhere: we found no state rule on tenancy legal fees in the sources we checked.

What to check

  • The lawyer's full name and Nigerian Bar Association details on the receipt.
  • That you receive a signed copy of the agreement you paid for.
  • That the agreement lists every fee, including service charge and caution deposit.
  • Whether "agreement fee" and "legal fee" are two charges for one document.
  • That you have time to read the agreement, or have your own lawyer check it, before you sign.

Red flags

  • A legal fee with no named lawyer.
  • Paying for an agreement you never receive.
  • Being charged again for a renewal where the terms have not changed.
  • A fee worked out on more rent than the period you actually agreed to.

Questions

How much is legal fee for house rent in Lagos?

The 2011 Tenancy Law sets no amount. A Lagos government adviser has said charges above a stated share of annual rent break state rules; the figures box gives it with its sources.

Is legal fee compulsory for tenants?

The law says whoever engages the lawyer pays. In practice most Lagos landlords make it a condition of letting. You can negotiate, or ask for a copy of the agreement to have it checked by your own lawyer.

What is the difference between agreement fee and legal fee?

Often nothing: both describe payment for the tenancy agreement. Some landlords list them separately. If you are charged both, ask what each one covers.

Does the new Lagos tenancy bill cap legal fees?

The draft text we read does not set a percentage for legal fees. It keeps the rule that the person who hires a professional pays them. The Bill is not law yet.
